The UK is bracing for exceptionally high temperatures that may reach 40C, prompting questions about the threshold for “too hot” working conditions. The UK Health Security Agency (UKHSA) has issued a red health warning for six regions in England, including the West Midlands, East Midlands, South East, South West, London, and the east of England, from 1 am on Wednesday to 11 pm on Thursday. Additionally, an amber health alert has been issued for the North West, North East, and Yorkshire and the Humber during the same timeframe.
Despite popular misconceptions, there is no specific legal maximum temperature for workplaces in the UK. However, employers are still responsible for ensuring the safety of their employees. Natalie Peacock, an employment lawyer at Rogers and Norton, highlighted the increasing challenge of extreme heat in workplaces nationwide. She emphasized that while air conditioning is not mandatory, employers must take reasonable measures to guarantee a safe working environment.
Peacock stressed the importance of employers proactively managing the risks associated with high temperatures. This includes allowing additional breaks, ensuring adequate hydration and cooling options for staff, conducting risk assessments related to hot weather, providing ventilation, and offering shelter or shade for outdoor workers. Flexible working hours or remote work options during peak heat hours are also viable solutions to alleviate heat-related discomfort for employees.
To safeguard employees working from home, employers should conduct risk assessments for home workspaces and consider providing amenities like fans. Peacock emphasized the ongoing duty of employers to protect their employees, even in remote work setups. By implementing simple adjustments and accommodating employee needs during extreme heat, employers can mitigate the impact of high temperatures on their workforce.
