Marks Electrical Ordered to Repay Customers £600K

Marks Electrical has been instructed to reimburse almost 40,000 customers who were automatically enrolled in extra paid services without consent. The company will compensate a total of £600,000, with each customer receiving an average refund of around £15. The Competition and Markets Authority (CMA) discovered that Marks Electrical had imposed charges on customers for additional services without their explicit approval.

These services included the removal and recycling of old appliances upon delivery of a new product, as well as unwrapping and disposal of packaging for new items. Businesses are prohibited from using pre-selected options or any form of automatic sign-up for supplementary services that come with a cost. In addition to the refunds, Marks Electrical was fined £720,000 for these practices.

Following the initiation of an investigation by the CMA and subsequent discussions with the regulatory body, Marks Electrical modified its sales procedures. Consequently, the company received a 40% reduction in its financial penalty. The CMA’s investigation spanned from April 2025, coinciding with the implementation of new consumer protection regulations, to November 2025.

Affected customers will be contacted by Marks Electrical, and refunds will be automatically credited to the original payment method. In cases where this is not feasible, customers will receive a refund via cheque. The reimbursement amount will vary based on the extent of the extra services that customers were charged for.

Marks Electrical specializes in selling various essential household appliances such as washing machines, dishwashers, and cookers. Emma Cochrane, the Executive Director of Consumer Protection at the CMA, emphasized that it is unacceptable to automatically impose additional charges on customers without their consent when purchasing expensive items like household appliances. Cochrane stated that businesses must refrain from automatic opt-ins for extra charges, and any violations will result in fines and refunds being enforced.

Mark Smithson, the founder and CEO of Marks Electrical, acknowledged the CMA’s findings and apologized for the inadequacy of their checkout process. He highlighted that the charges were for genuine services like old appliance collection, recycling, and packaging removal, but admitted that these services should have been presented more transparently during the checkout process. Despite respecting the CMA’s decision, Smithson expressed disappointment with the financial penalty, emphasizing Marks Electrical’s commitment to customer service and responsible growth.

Marks Electrical’s focus remains on serving customers, supporting its workforce, and upholding high standards. Smithson mentioned that the company has learned from this experience and is dedicated to meeting customers’ expectations.
