“Landmark Victory for Victims: Offenders Compelled to Attend Sentencing Hearings”

After receiving Royal Assent, the Victims and Courts Bill represents the successful outcome of a prolonged advocacy effort by grieving victims and families. The newly enacted protections signify a significant victory and highlight the positive impact of the justice system’s responsiveness to the needs of those it serves.

Victims and families often feel marginalized during legal proceedings that have a profound impact on their lives. The focus on procedural aspects in the criminal justice system can create a sense of distance and lack of empathy towards their suffering. Particularly during sentencing, when offenders opt not to attend hearings, victims and families finally find a platform to voice their experiences.

The families of Sabina Nessa, Zara Aleena, and Jan Mustafa channeled their immense sorrow into a determined campaign to ensure that the issue of offender non-attendance at sentencing was addressed. Notably, individuals like Jebina Islam and Cheryl Korbel played pivotal roles in bringing attention to the emotional toll caused by offenders’ refusal to participate in sentencing proceedings.

Personal accounts from individuals like Ayse, who stood alone in court reading words of grief to an absent offender, and Farah, who described the offender’s absence as a painful blow, underscored the urgent need for change in this aspect of the justice system.

The recent legislative changes, under the Victims and Courts Act, grant courts the authority to compel offenders to attend sentencing hearings. Non-attendance will now result in penalties such as extended sentences and loss of privileges, acknowledging the harm caused and providing a sense of accountability to the affected families.

These reforms were driven by the relentless efforts of victims and bereaved families who refused to be sidelined and demanded a more inclusive and responsive legal framework. The amendments, including those to the Unduly Lenient Sentencing scheme, extend the timeframe for victims to challenge sentences they deem inadequate, addressing systemic gaps that previously disadvantaged victims in seeking justice.

In line with these reforms, victims and bereaved families will now have an extended period of up to six months to request a sentence review, promoting fairness and justice. Additionally, a legal obligation will be imposed to inform victims about the existence of the Unduly Lenient Sentencing scheme, empowering families to challenge sentences effectively.

The enhanced powers granted to the Victims’ Commissioner through the Bill will ensure greater oversight of agencies’ responses to victims, emphasizing the importance of practical implementation and cultural changes within the justice system to uphold the intended reforms.

While the passage of the Victims and Courts Bill signifies a significant milestone, its true impact will be measured by the effective implementation and consistent application of the reforms. The government and criminal justice entities must now ensure that the promises made are fulfilled to deliver justice and support to victims and their families.
